TERMS AND CONDITIONS OF SERVICE

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEBSITE OR ENGAGING THE SERVICES OF CENTRAL WASHINGTON HOME INSPECTIONS. BY ACCESSING OUR WEBSITE, SUBMITTING AN INQUIRY, OR ENGAGING OUR SERVICES, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS.

These Terms and Conditions ("Agreement") constitute a legally binding agreement between you ("Client," "you," or "your") and Central Washington Home Inspections, owned and operated by Marc Fontenot ("Company," "we," "us," or "our"). This Agreement governs your use of our website and all inspection services we provide.

2. ACCEPTANCE OF TERMS

By using our website, submitting a contact or inquiry form, scheduling an inspection, or engaging any of our services, you confirm that you have read, understood, and agreed to these Terms and Conditions in their entirety, as well as our Privacy Policy, which is incorporated herein by reference.

If you are entering into this Agreement on behalf of a business entity or another individual, you represent and warrant that you have the authority to bind that entity or individual to these Terms and Conditions.

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to our website. Your continued use of our website or services following any such modification constitutes your acceptance of the revised terms.

 

3. DESCRIPTION OF SERVICES

Central Washington Home Inspections provides professional residential home inspection services in Central Washington State. Our inspection services include a visual examination of accessible systems and components of a property, including but not limited to:

• Structural components and foundation

• Roofing systems and components

• Exterior features and site conditions

• Plumbing systems

• Electrical systems

• Heating and cooling (HVAC) systems

• Interior components including walls, ceilings, floors, windows, and doors

• Insulation and ventilation where accessible

• Built-in kitchen appliances (where applicable)

All inspections are conducted in accordance with the standards of practice applicable to licensed home inspectors in the State of Washington and the guidelines of the applicable licensing authority under RCW Chapter 18.280.

Our inspections are visual in nature and are limited to observable, accessible conditions at the time of the inspection. We do not perform invasive, destructive, or technically exhaustive inspections unless specifically agreed upon in writing prior to the inspection.

 

4. SCHEDULING AND APPOINTMENT CONFIRMATION

Inspection services are scheduled by mutual agreement between the Client and the Company. An inspection appointment is confirmed only upon our written or verbal acknowledgment of the requested date and time.

It is the Client's responsibility to ensure that access to the property is available at the scheduled time of inspection. If access is not available at the scheduled time and we are unable to complete the inspection, the Client may be responsible for additional charges for a return visit.

We reserve the right to reschedule any inspection due to unsafe conditions, severe weather, or other circumstances beyond our reasonable control. In such cases, we will make every reasonable effort to provide timely notice and to reschedule at the earliest available time.

 

5. CANCELLATION AND RESCHEDULING POLICY

We understand that circumstances change. We ask that Clients provide as much advance notice as possible in the event that an inspection appointment needs to be cancelled or rescheduled.

We reserve the right to institute a formal cancellation fee policy in the future. Any such policy will be communicated to Clients at the time of scheduling and will be posted on our website. In the absence of a stated cancellation fee, we ask for reasonable professional courtesy and timely notice.

Repeated late cancellations or no-shows may result in our right to require advance payment before confirming future appointments.

 

6. PAYMENT TERMS

6.1 Accepted Payment Methods

We accept payment for services through the following methods:

• Cash

• Personal or business check (payable to Central Washington Home Inspections)

• Online payment platforms including but not limited to Venmo and Zelle

• Invoice / billing as agreed upon in advance

6.2 Payment Due Date

Unless otherwise agreed in writing, payment for inspection services is due in full at or before the time of the inspection. Delivery of the inspection report may be withheld until payment is received in full.

6.3 Returned Checks

In the event a check is returned for insufficient funds or any other reason, the Client will be responsible for the original inspection fee plus any applicable returned check fee and any bank charges incurred by the Company.

6.4 Disputed Charges

Any disputes regarding charges must be submitted to us in writing within ten (10) days of the invoice date. Failure to dispute a charge within this period constitutes acceptance of the charge.

 

7. INSPECTION REPORT

Upon completion of the inspection and receipt of full payment, we will provide the Client with a written inspection report summarizing our findings. The report will be delivered electronically unless another delivery method is agreed upon in advance.

The inspection report is prepared solely for the use and benefit of the Client named in the agreement. It is not transferable to, and may not be relied upon by, any third party without our prior written consent. We expressly disclaim any liability to third parties who may obtain or rely upon the report without our authorization.

The inspection report represents our professional opinion based on conditions observable at the time of inspection. It does not constitute a guarantee, warranty, or certification of any kind regarding the condition of the property, except as expressly stated in Section 8 of this Agreement.

The inspection report is not a substitute for a real estate disclosure, appraisal, survey, engineering report, or any other professional assessment. We strongly encourage Clients to consult qualified specialists for any condition noted in the report that warrants further investigation.

 

8. LIMITED WARRANTY AND GUARANTEE

8.1 General Services

Central Washington Home Inspections stands behind the quality and professionalism of its inspection services. While the specific terms of our guarantee are subject to the nature of the inspection performed and will be communicated to the Client at or before the time of engagement, our general commitment is to provide thorough, accurate, and professionally conducted inspections consistent with Washington State licensing standards.

In the event you believe a material condition was overlooked or misrepresented in your inspection report, you must notify us in writing within a reasonable time of discovery. We will work with you in good faith to review your concern. Our liability for any claim arising out of an inspection shall not exceed the fee paid for the inspection service.

8.2 New Construction 11-Month Warranty Inspection

For new construction properties, we offer an 11-Month Warranty Inspection service designed to be completed before the expiration of a builder's standard one-year warranty period. This service is intended to identify any defects, deficiencies, or construction issues that may have become apparent during the first year of occupancy and that may be covered under the builder's warranty.

The 11-Month Warranty Inspection is subject to the same scope and limitations as a standard home inspection: it is a visual, non-invasive examination of accessible systems and components. It does not guarantee the identification of every latent or concealed defect, nor does it constitute a guarantee regarding the builder's obligation to repair or remediate any identified issue.

It is the Client's responsibility to submit warranty claims to the builder within the applicable warranty period. We are not responsible for any claims not submitted timely or for a builder's failure or refusal to perform warranty repairs.

8.3 Exclusions

Our warranty and guarantee do not cover the following:

• Conditions that were not visible or accessible at the time of inspection

• Conditions that arose or worsened after the date of inspection

• Cosmetic defects or conditions that do not affect the function, safety, or structural integrity of the property

• Conditions excluded from the scope of a standard home inspection under Washington State standards of practice

• Any damage, loss, or expense arising from a Client's failure to timely act upon the findings of the inspection report

 

9. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF CENTRAL WASHINGTON HOME INSPECTIONS, ITS OWNER, EMPLOYEES, AND AGENTS, ARISING OUT OF OR RELATED TO ANY INSPECTION SERVICE OR THIS AGREEMENT, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, SHALL NOT EXCEED THE TOTAL FEE PAID BY THE CLIENT FOR THE SPECIFIC INSPECTION SERVICE GIVING RISE TO THE CLAIM.

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, OR COST OF SUBSTITUTE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

 

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Central Washington Home Inspections, its owner Marc Fontenot, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our website or services; (b) your violation of these Terms and Conditions; (c) your violation of any applicable law or regulation; or (d) any misrepresentation made by you in connection with the scheduling or performance of an inspection.

 

11. DISCLAIMER OF WARRANTIES

OUR WEBSITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on our website.

 

12. INTELLECTUAL PROPERTY

All content on our website, including but not limited to text, graphics, logos, images, and inspection report templates, is the property of Central Washington Home Inspections and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, transmit, display, publish, or otherwise exploit any content from our website or inspection reports without our prior written consent, except for your own personal, non-commercial use in connection with our services.

 

13. WEBSITE USE AND CONDUCT

By using our website, you agree that you will not:

• Use the website for any unlawful purpose or in violation of any applicable law or regulation

• Attempt to gain unauthorized access to any portion of the website or any systems or networks connected to it

• Transmit any harmful, offensive, defamatory, or otherwise objectionable content through our website or contact forms

• Use any automated tool, bot, or scraper to access or collect data from our website without our prior written consent

• Impersonate any person or entity or misrepresent your affiliation with any person or entity

We reserve the right to restrict or terminate access to our website for any user who violates these Terms and Conditions or who uses our website in a manner we deem inappropriate or harmful.

 

14. THIRD-PARTY SERVICES AND LINKS

Our website may contain links to third-party websites or services. These links are provided for your convenience only. We do not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party website. Your use of any third-party website is at your own risk and subject to that website's own terms and conditions.

 

15. GOVERNING LAW AND DISPUTE RESOLUTION

15.1 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

15.2 Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to this Agreement or our services, the parties agree to first attempt to resolve the matter informally by contacting us at [email protected] or 509-731-8039. We will make a good-faith effort to resolve any dispute within thirty (30) days of receiving written notice.

If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Chelan or Kittitas County, Washington. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Nothing in this section shall prevent either party from seeking emergency injunctive or equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.

15.3 Venue

To the extent that any court proceedings are permitted under this Agreement, you consent to the exclusive jurisdiction of the state and federal courts located in Central Washington.

 

16. SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

 

17. ENTIRE AGREEMENT

These Terms and Conditions, together with our Privacy Policy and any written service agreement or inspection contract signed by both parties, constitute the entire agreement between you and Central Washington Home Inspections with respect to the subject matter hereof, and supersede all prior or contemporaneous communications, representations, understandings, and agreements, whether oral or written.

 

18. WAIVER

Our failure to enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. Any waiver of any provision of this Agreement will be effective only if made in writing and signed by an authorized representative of the Company.
